By accessing this website and /or by placing an order, you accept these terms and conditions (the “Terms and Conditions”) in full and the documents referred to within them. If you do not agree to be bound by these Terms and Conditions, you must not use this website.
switchecig.com is provided solely for your personal use. You may not use this website for any commercial, illegal or unauthorized purpose including if you are of the age less than 18 years old.
The following Terms & Conditions apply to the use of the entire Site and/ or all orders placed by ‘You’ (the customer or user of this website) with Ellul & Ellul Holdings Ltd as the operators of switchecig.com. (“switchecig.com”, “we”, “us” or “our”) (otherwise also referred to as “the Company”), for all products displayed on this website.
Please do read these Terms and Conditions carefully as they contain important information about our and your obligations when using this website and the order/ purchase process.

Eligibility
To be eligible to purchase goods on this Site and to lawfully enter into and form contracts on this Site under Maltese law you must: (a) be 18 years of age or older; (b) register on the Site; and (c) be the holder of a valid quickcash, cashlink debit cards, visa card, MasterCard and/or have a valid paypal account.
Basis of Sale
Our website is set-up to guide you through the steps you need to place an order with us. Our order process allows you to check and amend any errors before submitting your order. Please take time to read and check your order at each page of the order process.
When you confirm and pay for your order, you offer to buy the Products at the prices indicated including any delivery charges that apply to your purchase.
After placing an order, you will receive an e-mail from us acknowledging that we have received your order.
If we are unable to supply you with a Product, for example because that Product is not actually in stock or no longer available or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for the Products, we will refund you the full amount as soon as possible.
Payment and Prices
The price of the Products and our delivery charges will be as quoted on the site at the time you submit your order and will be advised during the check-out process before you confirm your order. We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system.
The price of a Product is VAT inclusive at the applicable current rate chargeable in the Republic of Malta for the time being.
Product prices and delivery charges are liable to change at any time, but changes will not affect orders already placed.
Payment can be made using Quick Cash, Cashlink, Master Card, Visa and PayPal. Payment for the Products and all applicable delivery charges is in advance.
It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that:
- Where the Product’s correct price is less than the price stated on our site, we will refund the difference when dispatching the Products to you. However, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price; and
- if the Product’s correct price is higher than the price stated on our site, we will contact you in writing by e-mail as soon as possible to inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.
Delivery & Returns
Processing, dispatch and delivery in the Maltese jurisdiction takes 1-2 business days.
When processing your order, you will be asked to specify the ideal time for delivery. Our courier service operated by our delivery partners, Malta Post, endeavour to delivery the ordered products during those times. All items are delivered by Malta Post through registered mail and therefore a signature that acts as a receipt of delivery is required at the address indicated by you.
Delivery Charges in Malta
- Free courier delivery for orders exceeding the total value of 25 euros.
- Charges apply for total order value of 25 euros or less.
Delivery Charges in the European Union
- Free courier delivery for orders exceeding the total value of 50 euros
- Charges apply for total order value of 50 euros or less

Currently, we do not offer delivery outside the European Union. However, we do not exclude offering such service in the future.
We send your products in a sealed dispatch bag. Make sure that when you receive it, the dispatch bag is sealed. By accepting the delivery package, you warrant to accept the package unused.
Items not received
In the rare eventuality that items dispatched by our courier are not delivered, we will be unable to refund you before we have allowed 30 days to pass from the date of dispatch. If you still haven’t received your order after this time, please contact us and we can assist you. Please note there is a time limit of 3 months from purchase, after this no refund can be made for any undelivered product.
Refund & Returns
If you cancel the order before the product has been dispatched, we will issue a refund to your account of the amount debited as a result of your purchase. If you decide to cancel an order after we have dispatched the product/s, you will be under a duty to return them to us, at your own risk. All products should be returned within 14 days after the items have been delivered to you as per your legal rights. During the time until they are returned, you must retain possession of the Products and take reasonable care of them. You should return the Products to us unused (except to the extent necessary to examine them) and in the same condition in which you received them together with the original packaging and paperwork. Premium Resellers
Our online store is supported by a number of Premium Resellers across the Maltese islands. Premium Resellers are authorized to provide customer care services to our eCigarette customers and are trained to help you if you have any problems utilizing our products including assistance on returns, faults and/ or repairs. Furthermore, all products sold on the online store, including their parts and accessories may be purchased directly from the shops at the same prices offered online. The same rights & obligations arising from online purchases arise for in-shop purchases. The operators of these outlets are third-party operators and are only authorized to represent the Company when customer care service is being offered for online purchases. Cancel your order
Switchecig.com reserves the right to cancel any orders up to the point of delivery for products that have been listed at an incorrect price, rebate or refund, or contain incorrect information or typographical errors or are unavailable for any reason. The company has this right regardless of whether the order has been confirmed or your payment processed. If your account has already been charged for the purchase and your order is cancelled, we will issue a credit to your account in the amount of the charge.
It is not possible to cancel your order online, in the meantime, you may contact Customer Service. If it is too late and your order is already on its way, you can still return it in accordance with our returns policy and procedures. Please be advised that you cannot cancel an order that has already been dispatched and/ or delivered. Such product can only be returned as per returns policy and procedures aforementioned.
Limited licence to use website
Unless otherwise stated, Ellul & Ellul Holdings and/or its licensors own the intellectual property rights in the website and material on the website including all text, graphics, logos, button icons, images, data compilations and software used in connection with the Site. The trademarks, logos and service marks displayed on the Site are the registered and unregistered marks of Ellul & Ellul Holdings Ltd. All other trademarks not owned by Ellul & Ellul Holdings Ltd that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. Subject to the licence below, all these intellectual property rights are reserved.
We grant you a limited, revocable and non-exclusive license to access and make personal use of the Site. This limited licence does not include the right to:
- Republish material from this website (including republication on another website);
- Sell, rent or sub-license material from the website;
- Show any material from the website in public;
- Reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose;
- Edit or otherwise modify any material on the website; or
- Redistribute material from this website.
Limitations of Liability
We do not accept liability for any direct, indirect, special or consequential loss or for any business losses, loss of revenue, income, profits or anticipated savings, loss of contacts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data. Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit.

Indemnity
You hereby indemnify Ellul & Ellul Holdings and undertake to keep the company indemnified against any losses, damages, costs, liabilities and expenses (including without limitation to legal expenses and any amounts paid by the company to a third party in settlement of a claim or dispute on the advice of the companies legal advisers) incurred or suffered by Ellul & Ellul Holdings Ltd arising out of any breach by you of any provision of these Terms and Conditions, or arising out of any claim that you have breached any provision of these Terms and Conditions.
Breaches of these Terms and Conditions
Without prejudice to our other rights under these Terms and Conditions, if you breach these terms and conditions in any way, we may take such action as the Company deems appropriate to deal with such breach. If you default negligently or wilfully in any of the obligations set out in these Terms and Conditions (including our Privacy Policy), you shall be liable for all the losses and damages that this may cause to Ellul & Ellul Holdings Ltd
Your account details
You warrant that the personal information which you are required to provide when you register as a customer is true, accurate and current in all respects. See our Privacy Policy regarding the treatment of your personal information.
You are responsible for maintaining the confidentiality of your account and password and for taking all reasonable measures to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. If you have reason to believe that your password has become known to third parties, or is likely to be used in any way that is unauthorised by you, you should replace immediately.
Cancelling your Account
Your account can be cancelled by contacting Customer Service.
We reserve the right to refuse service and/or terminate accounts, without prior notice, if you violated these Terms and Conditions, or if we decide, in our sole discretion, that it would be in the Companies best interest to do so.
